General Terms and Conditions (GTC)

General

These General Terms and Conditions (GTC) serve to clearly govern the mutual legal relationships between the customer and trenderia gmbh. The GTC take effect upon publication in the online shop. Unless special conditions have been agreed and confirmed by us in writing, the following terms of business, delivery and payment apply, which the purchaser accepts when placing an order.

Conclusion of contract

All orders, agreements, supplements and amendments shall only be binding on us once they have been confirmed by us in writing. (Correspondence by e-mail is valid.).

Prices

The prices applicable are those in the current product overview in the online shop. However, errors are reserved and the prices we state are not mandatorily binding on us. Upon publication of a new price list or a change on our website, the previous price automatically becomes invalid. For special offers, we are only bound to the stated prices for the period of validity specified in the offer, and goods are only supplied while they remain available to us. A flat-rate surcharge is charged for packaging and transport. Cash-on-delivery charges are borne by the customer. All prices include statutory VAT.

Shipping and insurance

Our terms of delivery form part of our GTC and take effect here. You are free to choose the shipping method. Our delivery is insured by us with the respective carrier. In the event of any damage to the goods caused in transit, it is up to you to clarify the facts and the further course of action.

Terms of payment

Shipping within Switzerland and abroad is made only against advance payment, by credit card or cash on delivery. In the case of advance payment, goods are only shipped once the invoice amount has been definitively credited by the bank or upon presentation of a receipt by you. (Copies by fax or e-mail are accepted.) Any fraud or forgery of a receipt will be prosecuted and will result in a criminal complaint.

Purchase on invoice with instalment option (POWERPAY)

MF Group / POWERPAY, as an external payment service provider, offers the “purchase on invoice” payment method. With the single invoice, you can simply settle your online purchase by invoice. Should you forgo payment within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment arrangements. When purchasing on invoice, you accept the GTC of POWERPAY in addition to our GTC. (powerpay.ch/de/agb).

Delivery dates

Delivery takes place immediately or as agreed. Goods we have in stock are dispatched within 48 hours wherever possible. Items that we have to order have a longer delivery time. (depending on the delivery capability of our suppliers). In the event of uncertainty, any delivery dates apply from the clarification of the order and are not binding on us. Operational disruptions, traffic disruptions, stock overlaps or other cases of force majeure release us from the agreed delivery period and from the obligation to fulfil the order in full.

Withdrawal & returns

Customers have the right to return unused and non-activated products within 33 days of receipt.

The following are excluded:

• Custom-made and personalised products
• Software and licences with a broken seal
• Products that have already been activated
• Services that have already been rendered

Returns are made at the customer’s expense and risk.

A refund is made after the goods have been inspected.

Warranty and guarantee

We grant a warranty for the goods delivered within the scope of the statutory provisions of the Swiss Code of Obligations (CO). This warranty applies only to defects that occur under normal operating conditions and with proper use. It does not apply to defects caused by improper use, excessive strain, repair by unauthorised persons or normal wear and tear. Returns will not be accepted without prior agreement. Notices of defects must be given in writing without delay and within 6 days of receipt by the purchaser. (Correspondence by e-mail is valid.) We must be given the opportunity to remedy the notified defects within a reasonable period. For defects acknowledged by us, repair or replacement is carried out free of charge. Compensation for lost profits or for damage incurred is excluded. Returns from you must be made free of charge to us.

Wear parts such as, in particular, batteries, rechargeable batteries, power cables, adapters, lamps and software problems are excluded from the warranty by both trenderia gmbh and the dealer.

Where the manufacturer’s warranty extends beyond the warranty of trenderia gmbh or the dealer, trenderia gmbh or the dealer shall also grant it to the customer.

When a data carrier or a product containing a data storage device is handed over to trenderia gmbh or the dealer, a complete loss of data must be expected in every case. Customers are themselves responsible for proper data backup and the protection of their data. trenderia gmbh or the dealer accepts no liability for any loss of data.

Technical specifications and detailed descriptions

Technical specifications are compiled by us to the best of our knowledge and belief. However, we cannot be held liable for any incorrect information provided by our suppliers. Detailed descriptions and other product-specific information are in part copies of supplier information and serve to aid understanding. We cannot be held liable for errors or mix-ups.

Ownership

We retain ownership until our claims against the purchaser have been settled in full. This also applies if the goods delivered have been further processed, modified or resold.

Liability for our products

We cannot be held liable for liability claims and consequential damage arising from the operation of and with our products, as we are unable to monitor proper assembly, deployment and operation. Furthermore, trenderia gmbh or the dealer declines liability in the following cases:

• improper, non-contractual or unlawful storage, setting or use of the products;
• use of incompatible spare parts or accessories (e.g. power supply);
• failure to carry out maintenance and/or improper modification or repair of the products by the customer or a third party;
• force majeure, in particular damage caused by natural hazards, moisture, falls and impacts, etc., for which trenderia gmbh is not responsible, and official orders.

Special provisions for thermal drones

Thermal drones are intended for purely civilian use in Switzerland. Please note that thermal drones must be registered with the relevant authority for any form of cross-border use. This reporting obligation is transferred to you as the new owner upon purchase; we decline all liability. Please inform yourself in advance of any obligations you may have if you wish to use this item in countries other than Switzerland.

Data protection

If you wish to place an order, we ask you to enter confidential information such as your name and address, your e-mail address or your telephone number. We assure you that your data will be treated confidentially and used exclusively within the scope of the business relationship between you and trenderia gmbh. The data will not be made accessible to any external third parties or sold to third parties.

Changes to the GTC

We reserve the right to amend the GTC at any time. The GTC as published in the online shop at the relevant time shall apply.

Applicable law and place of jurisdiction

Swiss law applies. The place of jurisdiction for all disputes between the parties arising from a contractual relationship is Biel/Bienne.
